Legal notice
Welcome to MJ Auction Gallery. By participating in our auctions or purchasing from our online store (https://mjauctiongallery.com/), you agree to the following legally binding terms:
1. Nature of Sale
All items are sold "As Is, Where Is." While MJ Auction Gallery endeavors to provide accurate descriptions and high-resolution images, we do not warrant the condition, attribution, or authenticity of any lot. It is the buyer's responsibility to request condition reports prior to bidding.
2. Buyer’s Premium and Taxes
The final amount due will consist of:
-
The Hammer Price: The winning bid.
-
Buyer’s Premium: A standard percentage added to the hammer price (as specified in the auction details).
-
Taxes: Any applicable state, local, or VAT taxes based on the shipping destination.
3. Shipping Policy (The "Buyer Pays" Rule)
All shipping, handling, packing, and insurance costs are the sole responsibility of the buyer.
-
Estimated Costs: Estimates provided are based on weight, dimensions, and destination zip code. These are subject to change based on final insurance valuation.
-
Flat Rate: A standard delivery fee of $99.00 applies to most items within the United States, unless otherwise stated in the item description.
-
International Shipping: Costs vary significantly for international deliveries. Buyers are responsible for all customs duties, brokerage fees, and import taxes.
-
Separate Invoicing: Shipping fees may be invoiced separately by our third-party shipping partners.
4. Logistics and Liability
-
Release of Goods: Items will only be released for shipping or pickup once full payment for the invoice has been received and cleared.
-
Transfer of Risk: MJ Auction Gallery acts only as a facilitator for shipping. Our liability ends once the item is handed over to the carrier or shipping company.
-
Damage/Loss: MJ Auction Gallery is not responsible for any damage, loss, or delay occurring while the merchandise is in the possession of the carrier. All claims must be directed to the shipping company’s insurance provider.
5. Payment Terms
Successful bidders must pay their invoice in full within [X, e.g., 5] business days of the auction close. Failure to pay may result in the cancellation of the sale and the suspension of the buyer's bidding privileges.
6. Self-Arranged Shipping and Pickup
Buyers may choose to arrange their own shipping or local pickup. In such cases, MJ Auction Gallery must be notified at least 48 hours in advance. The buyer’s designated agent must provide proof of identity and a signed release form upon collection.
7. Governing Law
These terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
